COVID-19 SURGE CAPACITY – INDEMNITY

Irrespective of the arrangements noted within Section 13 of the Coronavirus Act 2020, HSC staff are ordinarily and routinely supported by the Department of Health through their employing organisation as detailed within HSC (SQSD) 5/10 Handling Clinical and Social Care Negligence and Personal Injury Claims. This support extends to deployment to a new area of work at their employing organisation/ trust, including an area out with their normal speciality, or at a different organisation/ trust, during the pandemic. Under this arrangement, the Department may provide indemnity for clinical negligence liabilities associated with coronavirus which are not covered by alternative indemnity arrangements.

Volunteers who have been sourced by NHS/HSC Trusts to assist with the delivery of clinical services will also be covered by these schemes.

The National Health Service (NHS), of which Health and Social Care (HSC) Northern Ireland is a part, has unlimited indemnity cover for all its employed staff and those providing their services as locums, bank staff and other self-employed roles.

The Department of Health and Social Care (DHSC) has made it clear that anybody working in redeployed or backfilling roles in the coronavirus pandemic response will have indemnity cover for their work.
