Professional Standards and Regulatory Frameworks

Safe delegation relies on both professional and organisational governance. Regulatory frameworks help define accountability, competence, scope of practice and decision-making, enabling professionals to work together safely and effectively.

Professional Standards and Regulatory Frameworks: Nursing and Midwifery Council (NMC)

The NMC Code requires nurses and midwives to be accountable for decisions to delegate. They must:

  • delegate only to competent individuals;
  • ensure appropriate supervision and support; and
  • confirm that delegated care meets the required standard.

When accepting delegated responsibilities, practitioners must work within their competence, raise concerns, seek support when needed, and prioritise safety.

Social Care Regulation

The Northern Ireland Social Care Council (NISCC) requires social care workers to take responsibility for delegated work, recognise the limits of their competence, maintain their skills, and work collaboratively with other professionals.

Key message: Effective delegation depends on clear accountability, professional competence, and adherence to relevant regulatory and professional standards.

Legislation, Policies and Procedures

Legislation, policies and procedures provide the framework for safe, effective and accountable delegation. They help nurses and midwives make informed decisions about what can be delegated, to whom, and under what conditions.

They ensure delegated care is:

  • Lawful and within professional and organisational requirements;
  • Safe, with appropriate competence, supervision and oversight;
  • Consistent, through clear processes and standards; and
  • Accountable, with defined roles and responsibilities.
Communication Processes
  • Clear communication supports coordinated care, shared accountability and timely escalation of concerns.
  • People receiving care should be actively involved in decisions about their care.
Workforce Competence
  • Staff must have the skills, training and support required to deliver delegated healthcare interventions safely.
  • Roles, responsibilities and scope of practice should be clearly defined.
Evaluation and Improvement
  • Delegation arrangements should be monitored and reviewed to ensure safe, effective and person-centred care.
  • Feedback, outcome measures and shared learning support continuous improvement.
